We are quite confident that it’s based on our old source code, that was stolen during june attack.
We released BitMerch in October 2012, and since that time we are working hard to improve our service. Since hack happened we have made several changes - lowered comission for example. BTCMerch didn't.
 
BTCMerch was released at the end of July 2013 while BitMerch in October 2012.
